1. GENERAL TERMS
1.1 these terms and conditions (“terms”) apply between You and Lende (“lende”, “we”, “us”) when You use our website and services (the “platform”).
through the platform, Lende provides the following services:
a) allows Users to sell items directly to Lende
b) allows Users to buy items from Lende
c) handles payments, delivery, and customer support
all users of the platform are referred to as “You” or “User(s)”.
1.2 these terms explain how the service works and what rights and responsibilities both You and Lende have.
Lende is not an intermediary between private sellers and buyers. Lende is the seller of record for all products sold on the platform and is responsible for the sale under these terms.
1.3 These terms replace all previous agreements about the service. Lende may update the terms at any time. Users will be informed by email or by notice on the platform.
2. REGISTRATION AND USE OF THE PLATFORM
2.1 You do not need to create an account to browse the platform or use most of Lende’s services. However, You may be asked to provide certain information (such as contact or payment details) when buying or selling items.
By using the platform or any of Lende’s services, You confirm that you have read and accepted these terms.
2.2 You are responsible for making sure your account information is correct and up to date.
2.3 Lende may review user activity and suspend or close accounts if there is suspected misuse or violation of these terms.
3. SELLING ITEMS
3.1 How it works:
Step 1: You send us a picture(s) of the item(s) you wish to sell through WhatsApp or any communication channel we provide.
Step 2: We evaluate the item based solely on the information and images you provide and respond with an offer price. You may accept our offer or negotiate.
Step 3: If both parties agree on a price, We arrange pickup of the item. Payment is made to You at the time of pickup.
3.2 Eligibility
Only eligible items may be considered for purchase. Eligible items typically include, but are not limited to:
• Electronics such as vacuum cleaners, hair dryers, mobile phones, headphones, monitors, keyboards, speakers, smart devices, and similar consumer electronics.
• Kitchen appliances including blenders, mixers, coffee machines, air fryers, microwaves, toasters, and other household kitchen devices.
• Furniture, including small and medium-sized household furniture items.
• Any other items Lende deems appropriate or eligible at its sole discretion.
We reserve the right to approve or decline any item based on condition, functionality, authenticity, completeness, market value, safety, or any other factor.
Submission of an item does not guarantee that an offer will be made or that Lende will purchase the item.
3.3 Offer Price & Negotiation
a) We set the initial offer price at Our discretion based on the photos, market value, model, condition, and other factors.
b) You may request clarification or negotiate the price; however, We are not obligated to modify the original offer.
c) If You accept Our offer and proceed to confirm a pickup, the agreed price becomes binding. However, this price is subject to inspection of the item at the time of pickup. If the item’s condition, model, completeness, or functionality differs from the description or photos provided, Lende reserves the right to revise the offer price or withdraw from the purchase upon pickup.
d) Once You have accepted Our offer and a pickup has been confirmed, the agreed price shall be final and not subject to further negotiation or revision initiated by You. If You no longer wish to proceed at the agreed price, We reserve the right to cancel the transaction. Lende also reserves the right to cancel the transaction at any time prior to completion of pickup.
3.4 No Obligation To Purchase
We are under no obligation to buy any submitted item.
We may decline to proceed with a purchase at any stage, including during the pickup and payment, especially if the item’s condition does not match the submitted photos or description.
3.5 Pickup & Payment
Pickup is scheduled at a mutually agreed time. All timings are flexible; We do not guarantee pickup within 24 hours or any specific timeframe.
Payment is made to the seller upon pickup, based on their preferred payment method, after verifying the item’s condition.
3.6 Seller Responsibilities
By using QuickSell, you confirm that:
• You are the legal owner of the item and have the right to sell it.
• The item is not stolen, counterfeit, or obtained unlawfully.
• All information and images provided are accurate and truthful.
• You will ensure the item is available and accessible at the agreed pickup time.
4. BUYING ITEMS
4.1 Lende sells refurbished or pre-owned products directly to You.
4.2 Lende is responsible for pricing, descriptions, and condition grading.
4.3 You should inspect items upon delivery and report issues according to Lende's return policy.
4.4 Lende manages shipping and delivery within Madrid, Spain and Berlin, Germany only.
4.5 Product condition may vary, but all items are checked before resale.
5. DELIVERY
5.1 A purchase is confirmed when You completes checkout and payment.
5.2 Lende arranges shipping to Your address, typically within 1-2 business days. In the case of the delay, Lende shall communicate this to You via email.
5.3 Delivery times are estimates and not guaranteed.
5.4 Lende charges a set delivery fee of €3 (THREE EURO) for all orders. This fee is non-refundable.
6. PAYMENTS
6.1 Payments are processed through a secure payment provider Shopify Payments.
6.2 You pay the full amount at checkout.
6.3 Refund are handled according to Lende's refund policy.
7. CANCELLATIONS AND RETURNS
7.1 You may cancel orders before shipment.
7.2 Returns are accepted if the request is submitted within 48 hours of delivery. A full refund is guaranteed.
8. USER RESPONSIBILITIES
8.1 Users must follow these terms and the law.
8.2 Users must keep their account secure.
8.3 Users are responsible for the information they provide.
9. LENDE'S RESPONSIBILITIES
9.1 Lende aims to keep the platform online but cannot guarantee uptime.
9.2 Service interruptions may occur for maintenance or technical reasons.
9.3 Lende is responsible for items it sells but not for user misuse.
10. LIMITATION OF LIABILITY:
10.1 Lende is not responsible for indirect or unexpected damages.
11. TERMINATION
11.1 Lende has the right, at its own discretion and without prior warning, to limit a User's access to the Service and/or refuse all correspondence with a User in the event that: a) there is a regulatory change that limits Lende’s ability to offer access to the Service ; b) any event beyond Lende’s control prevents Lende from offering access to the Service including, but not limited to, technical problems, capacity problems and communication problems; or c) Lende believes that a User is abusing the Service or otherwise acting in violation of the Terms. d) Lende considers that a User does not have good enough credit to use the Service.
12. PERSONAL DATA
12.1 The use of the Service includes the processing of personal data for various purposes. Lende is the personal data controller for all processing of personal data that Lende, or others on behalf of Lende, carry out within the framework of the Service. Personal data is information which can be directly or indirectly attributed to a person, for example name and address. Contact details for Lende can be found at the bottom of this information.
12.2 By accepting the Terms, Users consent to Lende processing: (i) contact details such as name, e-mail, phone number, address, (ii) payment details such as debit or credit card or bank account for payment, (iii) geographical position such as coordinates, (iv) detailed order history including receipts and timings, (v) IP address (vi) user information, about Users for the purposes specified under clause 13.3 below.
12.3 Lende may use, compile, process and analyze the information described above under point 13.2 above to administer the User's account with Lende, to market Lende and Lende’s potential partners' products and services, to analyze the User's use of the Service, for to ensure the Service's technical functionality and to fulfill obligations according to law or regulation. (i) Contact details are used to create an account with Lende and a rental advertisement. (ii) Payment details are used to be able to receive payment for rental objects or to be able to make a payment for rented objects. (iii) Geographical position is used to be able to show rental properties closest to you or the closest desired address. (iv) Order history is used to present the history to the user and to calculate response rates and average response times. (v) The IP address is used to create an account with Lende’s payment provider Shopify Payment.
12.4 Users have the right, free of charge, to receive information and register extracts about the processing of personal data that Lende carries out regarding Users. Users also have the right to request correction, deletion or blocking of personal data that is incorrect.
12.5 Other parties who receive your user data from Lende. We share your personal data with: (i) The police when investigating crimes. (ii) Stripe, Inc for payment processing. (iii) Sharetribe.com (iv) Heroku, Google Cloud Services and Amazon Web Services or such provider that replaces these from time to time for managing server environments such as databases and applications. (v) Intercom.io or such supplier that replaces it from time to time for handling customer support. (vi) Customer.io or such supplier replacing it from time to time for handling e-mails such as booking confirmation and welcome letters. (vii) LINK Mobility International or such supplier that replaces it from time to time for handling SMS notifications for rental bookings. (viii) IT consultants that we engage from time to time for service and development of our systems.

13. INTELLECTUAL RIGHTS
Unless otherwise stated in these Terms or in the Application, Lende, or Lende’s licensors, own all intellectual and other rights, including copyright and rights to trademarks and know-how, to the Service and the Application. Users may not, without Lende’s written consent, distribute, license, modify, copy or otherwise use the content of the Application to a greater extent than is required to use the Service, unless otherwise required by mandatory law.
14. OTHER
14.1 The Application is only directed towards Users who are preparing to access the Application from Spain, unless otherwise stated in the Terms and Conditions.
14.2 Users who access the Application from a location outside Spain are responsible for complying with local laws if, and to the extent, such laws are applicable.
14.3 If any provision in these Terms is deemed to be illegal, invalid or unenforceable for any other reason, then such provision shall be deemed omitted and shall not affect the validity or enforceability of any of the remaining provisions in the Terms. 16.4 These Terms constitute the entire agreement between Lende and the User regarding the use of the Service and replace all previous agreements and commitments with respect to this.
14.5 These Terms and Conditions have been drawn up and shall be interpreted in accordance with Spanish law.
15. DISPUTE RESOLUTION
If there is a dispute between Lende and the User due to these Terms or for another reason, the parties must first try to resolve the dispute by agreement. If the parties cannot agree, the dispute can be settled by the appropriate legal authorities.
